Un-"SAFE Act" Update

A lot of new info circulating.....

**"Hunters, shooters and gun owners across New York are seething mad about the anti-gun
legislation passed by the NYS legislature and signed by the governor. More than 10,000 showed
up at a pro-gun rally in Albany on Feb. 28 to voice their displeasure, the largest demonstration in
that city in modern times.
Here is an update on the status of the New York Secure Ammunition and Firearms
Enforcement Act of 2013, more commonly called the "SAFE Act." Two New York Supreme
Court justices last week ordered Gov. Cuomo's administration to prove by (first) March 11 and
(second) by April 29 that its recent assault on gun rights is actually constitutional.
If NY fails to prove its case in either of the courts and within the time frame provided, this
assault on our gun rights may be struck down entirely, or it may temporarily be rendered void
pending higher court appeals.
State Supreme Court Justice Gerald Connolly granted a hearing on March 11 to the 1,256
plaintiffs who are arguing, among other points, that the state's decision to waive the constitution
mandated three-day review before voting on bills represents a blatant violation of the state
constitution. Since there was no "emergency action" in the Act, this case has strong merit.
State Supreme Court Justice Deborah Chimes issued an order for the Cuomo
administration to prove the SAFE Act constitutional by April 29. This lawsuit was initiated by
Edward Holtz, a lawful gun retailer, who argues that the statute put him out of business, left him
with merchandise he cannot sell, and violated his rights.
There are literally dozens of other lawsuits currently being prepared, and they will be
submitted during the next few weeks. Any one of them could derail this statute. Constitutional
experts declare that it clearly violates both the U.S. and state constitutions.
Based on both the Heller and McDonald Supreme Court decisions, I agree. The U.S.
Supreme Court ruled that firearms "in common usage" cannot be restricted by state or federal
law. The SAFE Act's entire purpose is to restrict ownership of modern sporting rifles, so it
appears there is no way to support a case that this law complies with the Second Amendment.
And, the U.S. Constitution also prohibits ex post facto laws, which essentially turns
something that was legal into something illegal. The SAFE Act made lawfully possessed modern
sporting rifles and high capacity magazines instantly illegal, and turned many of their owners into
instant criminals.
Assembly Minority Leader Brian Kolb probably said it best with, "This is not a 'safe' act,
it's the wrong act." Thank you very much, Mr. Kolb."

**NY Sportsman Conservation Council had their annual meeting yesterday. Scope is on board of directors and attended. The sportsman council is 100% against the gun laws. They met with Cuomo and told them they are 100% against and want repeal.  Cuomo was shocked they were opposed and said the law doesn't effect the hunters at all and he lowered hunting license prices too. He is clueless.

The council told Cuomo that many hunters use AR15s and other guns he banned for hunting. Also they pointed out that majority of hunters also own guns and magazines he banned.

That is a big plus that NYSCC was 100% on board.

"Seething mad". Describes me very well. Still contemplating a hunting license boycott for this fall. It would be the first time in 45 years, excepting military service, that I would not hunt in ny (intentional lower case). I believe a judge did not grant an injunction today(?). Thanks for the update Fx

Cool!

Looks like as of today on the news that Feinstein's idiocy is going down the drain. They don't feel there is enough support to do anything with it (less than 40 of the necessary 60 votes:>).

I received this today:

Attention All Fellow New Yorkers,

Yesterday I received this from one of my law enforcements contacts regarding an announcement from Governor Cuomos's Division of Criminal Justice Services.
Governor Cuomo has dug his feet in and is now employing Gestapo like tactics to encourage NY citizens to report on their fellow NY citizens thru financial incentives that are derived from the taxes of New Yorkers.
.
The reward for "turning in" or "reporting" your neighbors  for suspected "illegal" activity regarding the regulations put in-place by the recently enacted NY SAGE Act is $ 500.00 for each individual case.

This is the State's way of enforcing the regulations that most, if not all, gun owners have publicly said they would not comply with.
This is eerily reminiscent of 1934 Germany.
How many brutal dictators can we all name who have taken similar measures of turning the people against one another in the past 100 years.

Press Release:
At a time when all of us are finding ourselves doing more with less, a reminder about a resource available from New York State that can assist you in your efforts to solve cases, prevent crime and better serve and protect your communities.

The state has established a toll-free tip line – 1-855-GUNSNYS (1-855- 486-7697) to encourage residents to report illegal firearm possession. The tip line also allows for information to be submitted via text – individuals can text GUNTIP and their message to CRIMES (274637). While the state will provide the administrative support and fund the rewards, the investigation and validity of the tip will be up to each local department.

To spread the word about this free resource, New York State is planning a comprehensive campaign, including public service announcements that will air on television and radio stations across Upstate.

The tip line can provide your agencies with another avenue for receiving intelligence about crimes being committed in your jurisdictions. This initiative is designed for communities where no tip lines are in place and is not meant to replace existing gun tip lines.

Here’s how the tip line operates:

The New York State Police staff the tip line 24 hours a day. Upon receiving a call, troopers will solicit as much information as possible regarding a firearm tip, while allowing the individual to remain anonymous. The caller will be informed that this program is not the traditional gun buyback program but rather is focused on identifying individuals who are carrying an illegal firearm.

The State Police will in turn contact the appropriate police agency with the lead to initiate an investigation. Staff from the Division of Criminal Justice Services (DCJS) will follow up with that agency to determine the validity of the lead. Once the investigation is completed, the police agency would convey to DCJS the outcome of the investigation.

If the information leads to an arrest for the illegal possession of a firearm, the anonymous “tipster†will be awarded $500. DCJS staff will handle all of the financial transactions.

State Police staff will explain the program in its entirety upon notifying an agency that a lead has been generated for their jurisdiction. If you have any questions in the interim, please contact DCJS Deputy Commissioner Tony Perez in the Office of Public Safety at 518-485-7610.

Even scarier was the item on Fox News today. Apparently the government has domestic drones the size of hummingbirds (or smaller) that can lock in on individual computers from above and monitor transactions of the computer user complete with facial recognition of the person and what they are viewing on screen. I have no idea how from a practical standpoint this is accomplished but that it what was said.
